U.S. Gift Card Terms and Conditions
These terms govern the purchase, redemption, and use of StayHia gift cards in the United States. The detailed sections below mirror the layout shown in your screenshots, including redemption rules, limitations, arbitration, severability, amendments, and related articles.
1. General. Gift cards can only be redeemed by eligible users in supported regions and are subject to account verification, fraud checks, and applicable payment requirements.
2. Redemption. Redeemed card value is added to your StayHia account balance and may be applied to eligible bookings and related charges as permitted by platform rules.
3. Limits and Restrictions. Gift cards may not be reloadable, refundable, or redeemable for cash except where required by law. Additional restrictions may apply based on jurisdiction, account standing, or transaction history.
4. Fraud and Misuse. We reserve the right to suspend redemption, remove credit, or restrict account access if we detect misuse, suspicious activity, or use inconsistent with these terms.
5. Additional Payment Method. Some redemptions and bookings may still require a valid supplemental payment method for verification, incidentals, taxes, or amounts exceeding the redeemed balance.
6. Cancellations and Adjustments. If a booking purchased using gift card credit is canceled or adjusted, refunds will be processed according to our cancellation and payment policies and may return to the original funding source or gift balance as applicable.
7. Disputes. Disputes related to gift card issuance, redemption, balance handling, or platform use may be governed by additional payment and service terms.
8. Arbitration Agreement. 8.4 Agreement to Arbitrate; Delegation. Disputes arising out of or relating to these gift card terms, their enforceability, interpretation, or related services may be resolved through binding arbitration on an individual basis, subject to applicable law and any explicit carve-outs.
8.5 Exceptions. Certain claims may proceed in court where required by law or where carved out under the applicable arbitration framework.
8.6 Arbitration Forum Rules and Governing Law. Arbitration procedures, service providers, and governing law may be determined under the selected arbitration agreement and any incorporated procedural rules.
8.7 Hearing/Location. Hearings may be remote or held in an applicable forum depending on claim size, arbitrator direction, and procedural requirements.
8.8 Fees and Costs. Filing fees, provider charges, and arbitrator costs may be allocated under governing arbitration rules, including possible waivers where legally required.
8.9 Improper Purpose Claims. Arbitrators may impose sanctions or cost-shifting where claims are brought in bad faith or for an improper purpose.
8.10 Arbitrator’s Decision. Written decisions may include findings and conclusions sufficient to explain the outcome and support enforcement where permitted.
8.11 Jury Trial Waiver. To the fullest extent enforceable, covered disputes are resolved without a jury.
8.12 No Class Actions or Representative Proceedings. Covered claims proceed individually and not as class, consolidated, or representative actions unless applicable law requires otherwise.
8.13 Offers of Judgment. The screenshots show offer-of-judgment language concerning pre-hearing written offers and cost consequences tied to final outcomes.
8.14 Severability. If any portion of the arbitration agreement is found unenforceable, the remainder continues where permitted.

8.16 Survival. Covered dispute-resolution provisions continue after termination where applicable.
9. Miscellaneous. Additional operational, issuer, assignment, and liability limitations may apply to U.S. gift cards.
10. Severability. If any term is invalid or inapplicable, it will be modified or limited as needed while the remainder stays enforceable to the fullest extent permitted.
11. Changes to Gift Card Terms. We may revise these gift card terms from time to time, and updated terms become effective as described in the revised notice language.
